Terms of Service

1) Agreement

These Terms govern your access to and use of the Sigilant Labs website, console, documentation, and related services (the “Service”). By accessing or using the Service, you agree to these Terms.

Operator. “Sigilant Labs” is a brand operated by Diptanshu Kumar (sole proprietor). Unless we enter into a separate written agreement with you, these Terms apply.

2) The Service

The Service evaluates candidate inference configurations and produces benchmarking artifacts and recommendations. Outputs are derived from measurements and automated evaluation logic; results can vary with hardware, model, runtime settings, and workload.

3) Accounts and access

• You must provide accurate information and keep it current.
• You are responsible for safeguarding credentials and for activity under your account.
• We may suspend or limit access to protect the Service, investigate abuse, or comply with law.

4) Inputs and Outputs

You may provide prompts, files, model identifiers, and configuration parameters (“Inputs”). The Service generates results, metrics, and recommendations (“Outputs”). You retain rights in your Inputs. As between you and Sigilant Labs, you may use Outputs for your internal purposes, subject to these Terms.

Outputs may be incomplete or incorrect. You are responsible for validating results and assessing suitability before production use.

5) Acceptable use

• Do not attempt to bypass access controls or disrupt the Service.
• Do not use the Service to violate law, infringe rights, or distribute malicious code.
• Do not submit regulated data (e.g., payment card data or medical records) unless we agree in writing.

6) Purchases, credits, and Merchant of Record

The Service is offered on a prepaid credit basis. Credits are service units consumed when runs execute; they are not currency and are not legal tender.

Paddle is the Merchant of Record for purchases made through checkout. Paddle collects payment, calculates and remits applicable taxes, and processes refunds to the original payment method in accordance with the refund policy and Paddle’s buyer terms.

7) Refunds

Refund eligibility is described on the Refund Policy page and may be affected by fraud/abuse checks and mandatory consumer rights where applicable.

8) Intellectual property

We retain all rights in the Service, including software, branding, and documentation. You may not copy, resell, or create derivative works from the Service except as permitted by law or by written permission.

9) Availability and changes

The Service may change over time. We may modify, suspend, or discontinue parts of the Service. We aim to minimize material disruption but do not guarantee uninterrupted availability.

10) Disclaimers

The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of liability

To the maximum extent permitted by law, Sigilant Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from or related to the Service.

Our total liability for claims related to the Service will not exceed the amounts you paid for the Service in the three (3) months preceding the event giving rise to the claim, or USD $100, whichever is greater.

12) Indemnity

You agree to defend and indemnify Sigilant Labs against claims arising from your misuse of the Service or violation of these Terms.

13) Governing law and disputes

These Terms are governed by the laws of India. Courts located in Mumbai, Maharashtra will have exclusive jurisdiction, except where mandatory law requires otherwise.
